The deadline for submission of public comments on the Army Corps of Engineers' proposed definition of "waters of the United States" under the Clean Water Act has been extended to October 20, 2014. Public comments can be submitted via the Federal eRulemaking Portal at http://www.regulations.gov, or by email to ow-docket@epa.gov. Comments can also be submitted by mail or hand courier. Submissions should reference Docket ID No. HQ-OW-2011-0880.
The proposed definition will apply to all CWA programs, including Section 402 NPDES and Section 404 dredge and fill permits. The proposed definition would allow the EPA and the Army Corps of Engineers to assert CWA jurisdiction over ponds, ditches, and other occasionally wet areas, even where these areas do not connect to a navigable waterway.
