EPA EXTENDS COMMENT PERIOD ON NEW DEFINITION OF “WATERS OF THE U.S.”

By TONI ELLINGTON

On Tuesday, October 6, 2014, the EPA announced that it was extending the deadline for comments on the proposed new definition of “waters of the United States” under the Clean Water Act.  The new public comment deadline is now October 20, 2014.

The extension, according to the EPA, is to give the public more time to process a report from the EPA Science Advisory Board issued in September which has reviewed the proposed rule and found there was a scientific basis to classify inland waters such as small streams, wetlands, and other waters such as ponds and prairie potholes as “waters of the United States.”

The proposed rule defining waters of the United States can be found at 79 FR 22188.  For more information, contact Toni Ellington at (504) 599-8500.
