STATUS OF LEVEE BOARD LAWSUIT

The Louisiana House Committee on Natural Resources voted on May 21, 2014, to take action to kill the lawsuit filed by the Southeast Louisiana Flood Protection Authority –East against 97 oil and gas companies for environmental damage from their historic operations.  The House Committee voted to have Senate Bill 469 apply retroactively to the lawsuit.  Senate Bill 469 specifies which Louisiana governmental entities can bring a lawsuit for claims within a coastal zone as being limited to only those agencies with a Coastal Zone Management Plan.  The Southeast Louisiana Flood Protection Authority-East does not have such a plan.   The amended language in the bill expressly states that the law is to apply retroactively.
