LEVEE BOARD BILL UPDATE

In an effort to appease opponents, Louisiana State Senator Robert Adley, R-Benton, LA, announced some changes to proposed Senate Bill 79 (“S.B.79”) last week. The Bill makes changes to the removal procedures for members of the Southeast Louisiana Levee Board. Even with the changes, Governor Bobby Jindal and future governors would be able to remove members of the levee board. Senator Adley’s proposed legislation is a political response to the lawsuit filed by the Southeast Louisiana Flood Protection Authority – East against ninety-seven energy companies for alleged failures to clean up and repair environmental damage from oil and gas exploration activities in southeast Louisiana. S.B.79 would allow the Governor to remove a levee board member if the member was found to be in violation of state law or public policy.
