EPA PROPOSES FRACKING DISCLOSURE RULES

The U.S. Environmental Protection Agency (“EPA”) has issued an advanced  notice of proposed rulemaking related to requirements for companies involved in hydraulic fracturing to disclose the chemicals being used in the process.  This proposed rulemaking is in response to a citizens’ petition sent by Earthjustice to the EPA pursuant to Section 21 of the Toxic Substances Control Act.

The advanced notice of proposed rulemaking was published on May 19, 2014, at FR 2014-11501.  Public comments are due on or before August 18, 2014.  Comments can be submitted by the following methods:

Via the Federal eRulemaking Portal:  http//www.regulations.gov.  Follow the online instructions for submitting comments.
