COASTAL EROSION LAWSUIT UPDATE

By TONI ELLINGTON

On May 7, 2014, the Louisiana Senate approved Senate Bill 469 (“SB469”), potentially stopping the environmental lawsuit filed by the Southeast Louisiana Flood Protection Authority – East against 97 oil and gas companies for unrepaired damages from their exploration and production op3erations.  SB469 would allow only governmental agencies with a Coastal Zone Management Plan to bring legal claims involving allegations in coastal areas.  The Southeast Louisiana Flood Protection Authority – East does not have a Coastal Zone Management Plan.

The bill does not affect similar lawsuits fined by Jefferson Parish and Plaquemines Parish.
